ToneShift LLC ("ToneShift," "we," "us," or "our") operates the ToneShift application and related services (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use ToneShift.

ToneShift is a business-to-consumer (B2C) service.
2. Eligibility and Minors
- ToneShift is intended for users 13 years of age or older.
- Users aged 13–17 may use the Service only with parental or legal guardian consent.
- ToneShift does not knowingly collect personal information from children under 13.
- If we become aware that we have collected personal information from a child under 13, we will delete it promptly.
- If you are a parent or guardian and believe your child has used ToneShift without consent, please contact us.
3. Information We Collect
3.1 Information You Provide
We collect the following information when you create or use an account:
- Required: Email address
- Optional: Name
ToneShift does not collect phone numbers.
3.2 Message Content and Personas
- ToneShift processes message content submitted by users to provide tone analysis and related features.
- Message content is stored persistently and may be associated with personas and conversations until deleted by the user.
- Users may delete individual messages, personas, or their entire account at any time.
3.3 Automatically Collected Information
We automatically collect certain information when you use the Service, including:
- Device and browser information
- IP address
- Usage data and interaction events
- Log data
4. Information Usage
4.1 How We Use Information
We use information to:
- Provide, operate, and maintain the Service
- Process tone analysis and persona features
- Manage accounts and subscriptions
- Communicate service-related updates and support messages
- Send marketing communications (with opt-out options)
- Improve product performance and user experience
- Detect, prevent, and address fraud, abuse, or technical issues
- Comply with legal obligations
4.2 Legal Bases for Processing (GDPR)
For users located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with similar data protection laws, ToneShift processes personal data based on the following legal bases, as applicable:
- Contractual necessity – to provide, operate, and maintain the Service, including tone analysis, personas, subscriptions, and account functionality.
- Legitimate interests – to improve the Service, ensure security, prevent fraud or abuse, and analyze product performance, provided these interests do not override user rights.
- Consent – where required by law, such as for certain marketing communications or cookie usage.
- Legal obligations – to comply with applicable laws, regulations, and lawful requests from authorities.
5. AI and Model Usage
5.1 AI Processing
- ToneShift uses the OpenAI API to process message content and generate tone-related outputs.
- Message content is processed solely to provide the Service.
- OpenAI is contractually restricted from using ToneShift data for unrelated purposes.
5.2 Model Training and Improvement
- Raw message content is not used to train or fine-tune AI models by default.
- ToneShift may use derived, de-identified, and non-reversible data (such as tone scores, embeddings, vectors, or aggregated metrics) to improve analytics, ranking, and product performance.
- Derived data is: De-identified, Aggregated across users, Non-reversible to original message content.
- This use of derived data occurs by default.
- Any future use of raw message content for training purposes would require explicit user opt-in.
5.3 Human Review
- By default, no human reviews user message content.
- Human access may occur only if required for security, legal compliance, or user-requested support.
6. Payments and Subscriptions
- ToneShift uses Stripe to process payments.
- We do not store full payment card numbers.
- ToneShift retains limited billing information, including: Billing email, Subscription status, Stripe customer identifiers, Invoices and transaction records.
- ToneShift offers free trials and recurring subscriptions.
- Subscription fees are generally non-refundable.
7. Cookies and Tracking Technologies
ToneShift uses cookies and similar technologies for Authentication, Analytics, and Marketing. Users may manage cookie preferences through browser settings.
8. Marketing Communications
ToneShift may send marketing emails. Users may opt out at any time. Transactional emails (billing, account) will continue regardless of preferences.
9. Sharing of Information
We do not sell or rent personal information. We may share information with:
- Service providers and subprocessors acting under confidentiality obligations
- Legal authorities if required by law
- Successors in connection with a merger or sale
10. Data Retention
- Account and message data is retained while your account is active.
- When you delete your account: Personal data is removed from active systems within ~30 days.
- Encrypted backups may retain data for up to 90-120 days before rotation.
- Certain records (billing, tax) may be retained longer as required by law.
11. Security
We implement reasonable Safeguards including encryption in transit and access controls. No system is completely secure.
12. International Users
ToneShift operates from the United States. We support GDPR-level privacy protections for users in the EU, UK, and Canada.
13. Your Privacy Rights
Depending on your location, you may have rights to access, correct, delete, or object to processing of your personal information.

You have the right to access, correct, delete, restrict, or object to processing, and the right to data portability. You can lodge a complaint with your local authority.

15. Third-Party Services
We are not responsible for the privacy practices of third-party websites linked within our Service.
16. Changes to This Privacy Policy
We may update this policy. Continued use constitutes acceptance of updates.
